Edward Duncan: Justice Denied

On April 18th 2003 Edward (Eddie) Duncan was driving his car in Montgomery County Texas, it’s unclear why he was pulled over by Trooper Mcanarney but he was. What follows is even more bizarre, based on the video from the Troopers dash cam.

In the video Duncan can clearly be seen rolling his window down to answer questions, words were exchanged and Duncan refused to open his door, seeing no justification for the request after providing the Trooper with the usual, license, registration and insurance. No warrant existed for Duncan and he wasn’t even speeding at the time of the stop.

The Trooper called another Officer to the scene, upon his arrival they can be seen on video talking about “getting” Duncan and “teaching him a lesson”. He is arrested and charged with “interfering with Duties of a Public Servant” . It is scheduled to be heard by Judge Martin.

Now fast forward to 2009, Judge Martin is finally ready to hear this case. Mr. Duncan arrives at the court house and the entire courtroom of those with pending hearings are given a form either requesting an attorney or waiving an attorney. Except Mr. Duncan, he is given no form and clearly states he wants an attorney.

He doesn’t get one and is remanded for trial, yes trial. The trial, yes they held a trial that lasted 2 days, he was found guilty, with no attorney wow what a surprise and given a 6 month sentence. Thats right, 6 months in jail because two Montgomery County Troopers were going to teach Mr. Duncan a lesson.

It gets better, a Writ of Habeas Corpus is file with Judge Martin, because he had no legal representation, the Judge should have granted the writ, but instead waited for the Prosecuting Attorney to FABRICATE a signed attorney waiver, one that wasn’t even relevant to the case before the court and the Judge denied Mr. Duncan his 6th amendment right.

Because in Montgomery County Texas citizens don’t have constitutional rights, they have a group of people who by God are going to do what ever the hell they please.

Here is a man still in jail, who committed no crime and has been denied his rights by a group of petty, power hungry men who decided to teach everyone who even thinks about their rights a very clear message, we are the power, do what we say when we say it, or else.

This is disgusting and makes me glad I don’t live in Texas, a State that has executed 13 children since 1972, the only other country that kills as many children is Iran with a total of 5 executed in the same time frame, even China came in last with one child executed.

How proud the Great State of Texas must be for putting an innocent man in jail, lets hope the Governor doesn’t here the appeal or this man might be executed too.

Isn’t that special.
